انتخابهاي ناصواب در حوزه ديپلماسي

Ahmadinejad’s Mal-Diplomatic Selections

On August 24, Iranian President Mahmoud Ahmadinejad appointed four new diplomatic representatives to his administration: Esfandiar Rahim Masha’i as his Special Representative on Middle East affairs, Hamid Baqa’ee as his Special Representative on Asian affairs, Mohammad-Mehdi Akhoundzadeh as his Special Representative on Caspian affairs, and Abolfazl Zohrehvand as his Special Representative on Afghanistan affairs. Ahmadinejad’s choices have lead to protests, particularly among the Majles Committee for National Security and Foreign Affairs.
‘Special Representative’ is a 100 percent diplomatic post. That means it belongs to a seasoned diplomat, not (even) a prominent politician. One who is appointed as a special representative should fulfill the following requirements:

1. Should have high-level diplomatic experience.

2. Should be knowledgeable about the problems and challenges of the related geographical entity, its strategic affairs, and his subject country’s macro-policies regarding the designated area. Otherwise, s/he will face many impasses and could hurt national interests of his country with inappropriate remarks.

3. Should be acknowledged as a professional in the diplomatic apparatus. The rationale is clear: the diplomatic body is not the possession of a single individual or organization in Iran. Various power centers influence the ultimate direction of Iran’s foreign diplomacy, including the leadership of the country, the executive power, the Majles Committee for National Security and Foreign Affairs, and Council of National Security. Lack of consensus over the president’s favorite choice for special representative will created disorder and contradiction.

But do Ahmadinejad’s choices fill these requirements? Interestingly, one of the special representatives, Hamid Baghaei, has no diplomatic experience, not even for a single day. I doubt if his expertise reaches even that of a low-ranking expert in the Foreign Ministry. Another choice, Esfandiar Rahim Masha’i, known for his widely criticized precipitous remarks on befriending the Israeli ‘nation’, is not a consensus candidate and will face serious opposition in his mission. Masha’i’s controversial character will exhaust Ahmadinejad’s time and energy, if only in defending his cabinet’s ‘jewel of the crown’. Abolfazl Zohrehvand is neither a flexible figure nor is he familiar with diplomatic nuances. Mohammad-Mehdi Akhoundzadeh is the only relatively professional diplomat among the four, and I hope he can serve our national interests in the highly complicated area of Caspian affairs, which is one of Iran’s toughest diplomatic challenges.

Ahmadinejad has not breached the law by appointing special representatives, but his choices raise serious doubts. Granting such critical responsibilities to officials unfamiliar with diplomatic affairs will seriously damage our diplomatic objectives and merely create a contradiction between the Foreign Ministry’s agenda and those of the special representatives.

Creating a position as Special Representative on Asian Affairs is also a matter open to question. Special representatives are appointed in areas where due to the multifaceted, extensive nature of affairs, ambassadors –who are also the president’s representatives- fail to engage with the whole range of challenges. For instance, Middle East affairs are complicated due to the presence of several influential political entities such as Israel, Palestine, Syria, Egypt, and Jordan. In Afghanistan, the engagement of Pakistan, India, Russia, the U.S., and multinational troops makes the situation complex; and in the Caspian Sea, five littoral states and their disagreement over each one’s share of the sea calls for a special representative. But does that hold true for the largest, most diverse continent of the world? Japan, India, China, and Russia each occupy a separate power bloc. And there’s another question: Ahmadinejad has focused major diplomatic efforts on Africa and Latin American during this presidency. So why hasn’t he appointed a special representative for those regions?

ناکارآمدی دیپلماسی پوپولیستی

The Fruits of Mottaki’s Shuttle Diplomacy

On June 9, 2010, the United Nations Security Council adopted Resolution 1929 by a majority of twelve votes in favor, two against (from Turkey and Brazil), and an abstention by Iran’s strategic ally, Lebanon.
The five permanent members of the Council (the United States, France, Britain, Russia and China) had expressed their support for the resolution in advance. The other seven members who voted in favor of the resolution, namely the African countries of Nigeria, Gabon and Uganda (all members of the Non-Aligned Movement), Japan, Austria, Mexico and Bosnia-Herzegovina, ignored Iran’s requests to either be against the resolution or abstain from voting, preferring to side with the global powers.

The first reaction to the resolution came from President Ahmadinejad. During his visit to Tajikistan, in response to a question about the resolution, he said, “these resolutions are petty for the Iranian nation. I send a message for one of them (leader of an unidentified power) that the resolutions you pass are like a used tissue that must be thrown into the bin afterwards”. Ahmadinejad made similar comments during his visit to China.

Undoubtedly, the Iranian diplomatic apparatus went to great lengths to avert another sanctions resolution. Foreign Minister Manouchehr Mottaki’s trips to most permanent and non-permanent UNSC member countries are the best proof of Iran’s eforts. To advance Iran’s diplomatic agenda, he even dared invite the U.S. Ambassador to the United Nations, Susan Rice, to a dinner ceremony at the Iranian UN Ambassador’s residence. Rice, nonetheless, like some other Western senior diplomats, chose to send a lower-ranking diplomat to the extraordinary dinner. (Translation: the invitation was rejected.) And the Japanese Ambassador merely referred to the “frank exchange of ideas” during the dinner.

Iranian state-run media tried their best to put a shine on Mottaki’s visits, even in cases such as his trips to Gabon and Uganda. While it was always clear that these countries neither want to nor can vote against the will of global powers, reports tried to imply that these countries would ultimately side with Iran. Uganda, Gabon, and Nigeria were the three countries that Ahmadinejad later claimed were under “unrelenting pressure” to vote in favor of the sanctions.

Mottaki’s visit to Bosnia-Herzegovina also became controversial. Even before the Iranian foreign minister’s visit, the Presidency of the Bosnia-Herzegovina released a statement voicing its support for the likely sanctions resolution of the UNSC against Iran. The same words were repeated by Haris Silajdžić, Chairman of the Presidency. Mottaki’s response to the Bosnian diplomat failed to heal the wounded dignity of Iranians. Clearly, such behavior from the Bosnians would not have been tolerated in the time of Kamal Kharrazi –Khatami’s foreign minister- or even Ali Akbar Velayati, Iran’s foreign minister from 1981 to 1997.

Even Japan was not ignored by Mottaki, although he was aware of Tokyo’s unalterable stance on the sanctions. Ironically, Ahmadinejad scoffed at Japan after the adoption of the resolution: “how could a country hosting U.S. military bases vote independently?” he questioned. “Definitely, it can’t vote in independence.”

Parallel to Mottaki, Ahmadinejad exploited full diplomatic potentials to influence the course of events leading to decisions on new sanctions. During his most recent visit to New York (to attend the UN NPT Review Conference), in an interview with the Boston Globe, the Iranian president tried to tie a new resolution to Iran-U.S. relations: “Any connections and contacts with Iran, the pathway to Iran, will be shut permanently," he said, if tougher sanctions were passed. "Those who are trying to radicalize the atmosphere here fail to understand that they are speedily moving towards the cliff.”. And Ahmadinejad’s diatribe against the Russians and his demand from Moscow that it shows transparency received a tough response from Kremlin.

In order to advance nuclear negotiations, Ahmadinejad did his level best to convince Turkish Prime Minister Erdogan to attend the G15 conference in Tehran. Erdogan, however, agreed to travel to Tehran only after he was assured of Turkey’s central role in the nuclear swap deal. The outcome was Tehran Declaration, a positive but overdue step.

Even a country like Uganda –that plays a marginal role in Iran’s foreign policy- attracted the attention of Iranian statesmen. It would be perhaps the last time Uganda could boast of hosting three Iranian senior officials in a row, namely the president, the foreign minister and speaker of the parliament. And as usual, Iran did not forget to offer Russia and China economic sweeteners to help get rid of the ‘used tissue’.

Despite all this, it seems the high price Iranians have paid has returned no benefits. The resolution was ratified and our diplomats will return to the negotiating table while the key members of the Security Council -which according to Ahmadinejad “is a tool in the hands of the United States, not the world’s nations, and has a dictatorial structure”- hold the upper hand.

Nevertheless, contrary to what the president claims, the resolution will not block the way toward negotiations with the United States. Those assigned by the government to negotiate with the U.S. will definitely not abort their mission.

A survey by independent institutions might show what a heavy price the Iranian nation has paid for the sinuous stances of the government and its radical rhetoric that merely serves domestic purposes. After all the dust-ups die down, the question which will emerge will be, who is responsible for the administration’s withdrawal from Dignity, Wisdom and Expediency—the pillars of our foreign policy set by the Supreme Leader? Who is going to compensate for the harmed dignity of a nation due to the arbitrary behavior of the government?

حفظ مصلحت کودک یا حفظ اصول بنیادین

نگاهی به اختیارات مادر در نظام حقوقی خانواده

آن جا که مصلحت کودک در تعارض با دیدگاه سنتی قانونگذار قرار می‌گیرد، قانونگذار از تلاش برای تبیین قوانین با واقعیت‌های بیرونی باز می‌ماند و حفظ مصلحت کودک موقعیت تعیین کننده خود را از دست می‌دهد. یکی از مسائل مهمی که موجب این اختلاف دیدگاه قانونگذار با اهداف او می‌شود، تعیین تکلیف عملی اداره امور مالی و جانی کودکان است و این مساله که چه کسی این مسئولیت را برعهده خواهد داشت

شهرزادنیوز: هدف نهایی قانونگذار از تصویب قوانین خاص برای کودکان چیست؟
طرح این پرسش ما را به سمت پاسخی ساده سوق می دهد یعنی "حفظ مصلحت کودک"؛ که خلاصه ی جامعی از پاسخ های ممکن به نظر می رسد، اما متاسفانه با مطالعه قوانین جاری ایران، در ارتباط با وضعیت حقوقی کودکان به چنین پاسخ روشنی نمی رسیم
.
آن جا که مصلحت کودک در تعارض با دیدگاه سنتی قانونگذار قرار می‌گیرد، قانونگذار از تلاش برای تبیین قوانین با واقعیت‌های بیرونی باز می ماند و حفظ مصلحت کودک موقعیت تعیین کننده خود را از دست می دهد
یکی از مسائل مهمی که موجب این اختلاف دیدگاه قانونگذار با اهداف او می‌شود، تعیین تکلیف عملی اداره امور مالی و جانی کودکان است و این مساله که چه کسی این مسئولیت را برعهده خواهد داشت
به عبارت دیگر زمانی که قانون گذار برای تعیین سرنوشت حقوقی کودک مجبور به تعیین نقش پدر و مادر او می شود، با توجه به جایگاه فقهی پدر و جد پدری و انکار کامل نقش مادر در آن جایگاه، به طور کامل نگاه خود را از واقعیت‌های بیرونی به سمت اصول مدون فقهی می چرخاند
برای وارد شدن به بحث جایگاه حقوقی مادر در نظام خانواده در ایران شناخت عوامل تصمیم گیرنده در امور کودکان ضروری به نظر می رسد؛ که به ترتیب زیر قابل بررسی هستند
سرپرست - در نقش ولی قهری
وصی - در نقش جانشین ولی
دادستان و اداره امور سرپرستی - در نقش جانشین ولی و وصی
قیم - پس از فوت ولی قهری و در نبود وصی
مسئول نگهداری کودک - مسئول در امر حضانت
امین - درصورت نیاز و با تشخیص دادگاه
هر چند همه عوامل یاد شده، در سرنوشت کودکان نقش مهمی ایفا می کنند، اما تفاوت های بنیادینی با یکدیگر دارند و تشخیص حدود اختیارات اشخاص در هر سه آنها اهمیت ویژه ای دارد
سرپرست، جایگاهی انحصاری دارد
طبق قانون مدنی ، پدر و جد پدری کودک و وصی منتخب آنها برای بعد از فوتشان، ولی قهری و ولی خاص نامیده می‌شوند و نقش سرپرستی کودک، بدون قید و شرط به آنها محول شده است
اختیارت جد پدری به موازات اختیارات پدر است و هر دو از حق مساوی نسبت به کودک برخوردارند
اگر هر کدام از آنها فوت کند، دیگری به تنهایی عهده دار این حق خواهد بود
و بنابر این در غیاب پدر و درصورت زنده بودن جد پدری، حتا دادگاه نیز حق نظارت به امور کودک را ندارد و جد پدری همانند پدر اصلی کودک، دارای تمام اختیارات مالی و حقوقی کامل خواهد بود
پس از پدر و جد پدری، سرپرستی کودک به شخصی که از طرف آنها تعیین می شود و وصی نامیده می شود، محول می گردد
یعنی آن دو می توانند برای بعد از فوت خود نیز تکلیف کودک را مشخص کرده و اختیارات او را به فرد مورد نظر خود بسپارند
سرپرست حاکم مطلق سرنوشت کودک محسوب می شود؛ او از حق تصمیم گیری بدون قید و شرط و با حدود اختیارات کامل برخوردار است
هیچ مرجعی حتی دادگاه قادر به عزل سرپرستی پدر و جد پدری نیست
سرپرست تنها شخصی است که اداره امور مالی کودک در دست او قرار می گیرد و می تواند به نام کودک هرگونه معامله نقدی و غیرنقدی را انجام دهد
اجازه خروج کودک از کشور از اختیارات سرپرست کودک است
اجازه عمل جراحی در بیمارستان و نیز تعیین سرنوشت آموزشی کودک، تعیین آموزشگاه و مدرسه او و صدها مورد ریز و درشت دیگر از اختیارات سرپرست است و همه این موارد نقش انحصاری سرپرست را در اداره همه امور کودک نشان می دهد

نقش مادر در سرپرستی کودک
قوانین ما براساس نقش تعیین‌کننده مرد در تصمیم‌گیری‌های اقتصادی و اجتماعی دوران قدیم و براساس نظام مردسالار خانواده‌ سنتی، سرپرستی کودک را بدون قید و شرط به پدر و جد پدری و بعد از فوت هر دو به وصی منتخب آنها سپرده است
اما اگر کودکی نه ولی خاص و نه وصی داشته باشد، سرپرستی باز هم به مادر سپرده نمی شود بلکه دادستان جای ولی و وصی را می گیرد و برای کودک قیم تعیین می کند که خود قوانین جداگانه ای دارد
آن چه که از مطالعه این قوانین به دست می آید، این است که مادر هرگز به نام سرپرست قانونی کودک خوانده نمی شود
هیچ نقشی هرچند اندک و ناچیز در سرپرستی کودک به مادر محول نشده است
اگر او بخواهد در اداره امور کودک دخالت کند، ممکن است در قالب قراردادها و مناسبات حقوقی دیگری از قبیل وکالت یا حضانت، اختیاراتی به او محول شود و در این صورت نیز حدود اختیارات او با تعیین سرپرست خاص و یا مراجع قانونی خواهد بود

وصی در جایگاه ولی خاص
همان طور که گفته شد پدر و جد پدری حتا بعد از فوت خود نیز برای کودک تعیین تکلیف می کنند و به این وسیله می توانند با تعیین وصی مانع تعیین قیم از طرف دادگاه شوند
به طوری که اگر مادر در مقام قیم می توانست بعد از فوت سرپرستان، اندک دخالتی در امور فرزند خود داشته باشد با ظهور وصی در وصیت نامه ولی، قادر به این دخالت اندک نیز نخواهد بود
وصی تمام اختیارات ولی خاص را داراست و می تواند به نام کودک خرید و فروش انجام دهد و تمام مناسبات حقوقی مرتبط با جسم و جان و مال کودک را اداره کند
دادستان و اداره امور سرپرستی با ایفای نقش یک کارمند
هرچند در غیاب ولی خاص و وصی انتظار می رفت که این بار نوبت به مادر کودک برسد و او بتواند عهده دار این نقش شود باز هم می بینیم قانون مادر را به اندازه کارمند اداره سرپرستی صلاحیتدار کودک خود نمی داند و بلکه این بار نوبت به مدعی العموم می رسد که کودک را سرپرستی کند
در اصل در این مرحله کودک که صغیر نامیده می شود بی سرپرست تلقی شده و بنابر این مرجع نهاد عمومی نسبت به سرنوشت او تصمیم می گیرد
اداره امور سرپرستی قادر است نگهداری و حفاظت از جان و مال کودک را به قیم بسپارد اما قیم زیر نظارت کامل این اداره قرار دارد و قادر به انجام بسیاری از امور کودک نیست
هرچند مادر برای قیومیت دارای حق اولویت است اما نقش او نه به عنوان سرپرست بلکه به عنوان قیم در مقام بررسی قرار می گیرد، و علاوه بر آن در صورت ازدواج مجدد، قیومیت او باید به امضای همسر او نیز برسد

قیم اختیارات محدود و معینی دارد
درصورتی که کسی به مقام قیومیت کودک منتصب شود موظف به پاسخگویی به اداره امور سرپرستی و گاه اشخاص تعیین شده از طرف این اداره خواهد بود
قیم باید تمام معاملات و امور مالی و هم چنین تصمیمات خود را راجع به سرنوشت جانی کودک را به نظر نماینده دادستان برساند و در بسیاری از موارد قادر به انجام امور مالی کودک نیست

اختیارات فرد مسئول در حضانت، محدود به امر نگهداری است
حضانت موقعیتی است که در آن فردی که مسئول آن شناخته می شود می تواند فقط نسبت به اموری که نگهداری کودک ایجاب می کند، تصمیم بگیرد
این امور هرگز نمی تواند از دایره اختیارات دایگی و مراقبت از کودک فراتر برود؛ مگر این که سرپرست قانونی کودک اختیارات بیشتری به او اعطا نماید
در زمانی که حضانت کودک به فردی غیر از ولی او سپرده شود، او نمی تواند به نام کودک معامله ای انجام دهد، یا اموال کودک را اداره کند و به جای سرپرست کودک نسبت به سرنوشت او تصمیم بگیرد و همان طور که گفته شد فقط سرپرست کودک است که می تواند نسبت به اموال و دارایی ها و امور جسمی و سرنوشت کودک تصمیم گیرنده باشد

اختیارات محدود مادر در حضانت کودک
با وجود این که اختیارات کسی که حضانت کودک را به عهده می گیرد فقط در حد نگهداری و مراقبت از کودک باقی می ماند اما قانون گذار حتا در سپردن این مسئولیت به مادر که حق محدودی را برای او ایجاد می کند شروط بسیاری قرار داده است که عمده این محدودیت ها به شرح زیر است
محدودیت زمانی حضانت: حضانت کودک فقط تا 7 سالگی او به عهده مادر است
محدودیت در موقعیت مادر: مادر در مراقبت از کودک خود در همان مدت محدود نیز مشروط به این است که در این مدت ازدواج مجدد نکند . به بیان دیگر مادر باید سرنوشت آینده خود را برای نگهداری و مراقبت از فرزند خود قربانی نماید و آن هم در شرایطی که این حق محدود، متزلزل و کوتاه مدت است

امین در مناسبات حقوقی نقشی واقعی پیدا نکرده است
تنها جایی که قانون برای اعمال و رفتارهای ولی و سرپرست قانونی کودک جای نظارت باقی گذاشته و پیش بینی مصلحت آمیز کرده، آن جاست که سرپرست یا کسی که مراقبت کودک را به عهده دارد، مرتکب خیانت شود و یا لیاقت نگهداری او را نداشته باشد
در این صورت نیز سرپرستی از ولی قهری سلب نمی شود بلکه دادگاه برای نظارت به امور کودک، امین تعیین می کند
نقش امین نقش نظارتی است که نسبت به نحوه نگهداری و حفاظت از کودک و اداره امور او صورت می گیرد
اما شرایطی که نصب امین در دنیای واقعی ایجاب می کند، این تنها راه نظارتی بر رفتار سرپرست را نیز مسدود کرده است
چرا که در دنیای واقعی، اثبات بی لیاقتی و یا خیانت سرپرست، کاری مشکل و گاه امکان ناپذیر است و مستلزم گشودن پرونده و آوردن دلایل محکمه پسند و اثبات آن در دادگاه می باشد
در دنیای واقعی حتا وقتی پدر کودک را آزار جسمی و یا روحی می دهد اثبات این که این رفتارهای او برای تبیهه و تربیت کودک نبوده و یا خارج از حدود لازم بوده، مشکل به نظر می رسد. و باید توجه داشته باشیم که طبق قانون مدنی پدر حق دارد برای تربیت کودک او را تادیب بدنی کند
و یا وقتی پدر بخواهد اموال کودک را به فروش رسانده و در اموال خود ادغام نماید اثبات این که این کار او به مصلحت کودک نیست کار راحتی به نظر نمی رسد چون اصل بر تشخیص درست از طرف سرپرست است مگر خلاف آن ثابت شود
و بنابر این انتصاب امین در کنار سرپرست کودک چندان رواجی نخواهد داشت
و مادر کودک فقط می تواند ناظر هرگونه رفتاری باشد که به کودک او از طرف پدر و جد پدری و یا وصی کودک روا داشته می شود و قادر نخواهد بود کمترین نقشی در تصمیم گیری آنها داشته باشد و یا در مقابل رفتارهایی که تشخیص می دهد برای کودک او مناسب نیست، بایستد
نتیجه آن که در مناسبات حقوقی مادر با فرزند خود نقش مراقبت از کودک آن هم به شکل محدودی به او داده شده و این نقش نیز بسیار متزلزل، ناپایدار و کوتاه مدت است

ماده ۱۱۸۱ هر یک از پدر و جد پدری، نسبت به اولاد خود ولایت دارند
ماده ۱۱۸۳ - در كليه امور مربوطه به اموال و حقوق مالي مولي عليه ، ولي نماينده قانوني اومي باشد
ماده ۱۱۹۴ پدر و جد پدری و وصی منصوب از طرف یکی از آنان، ولی خاص طفل نامیده می‌شود
ماده ۱۱۹۰ ممكن است پدر يا جد پدري به كسي كه به سمت وصايت معين كرده اختيارتعيين وصي بعد از فوت خود را براي مولي عليه بدهد
ماده ۱۱۷۰ اگر مادر در مدتي كه حضانت طفل با او است مبتلا به جنون شود يا به ديگري شوهر كند حق حضانت با پدر خواهد بود
ماده ۱۱۷۶ مادر مجبور نيست كه به طفل خود شير بدهد مگر در صورتي كه تغذيه طفل به غير شير مادر ممكن نباشد
ماده ۱۱۸۴ هرگاه ولي قهري طفل لياقت اداره كردن اموال مولي عليه را نداشته باشد و يا در مورد اموال او مرتكب حيف و ميل گردد به تقاضاي اقرباي طفل يا به تقاضاي مدعي العموم بعد از ثبوت عدم لياقت يا خيانت او در اموال مولي عليه به طرفيت مدعي العموم در محكمه حاكم يك نفر امين به ولي منضم * مي كند همين حكم در موردي نيز جاري است كه ولي طفل به واسطه كبر سن يا مرض يا امثال آن قادر به اداره كردن اموال مولي عليه نباشد
ماده ۱۱۷۳ - اصلاحي ۱۱/۸/۱۳۷۶ هرگاه در اثر عدم مواظبت يا انحطاط اخلاقي پدريا مادري كه طفل تحت حضانت اوست صحت جسماني و ياتربيت اخلاقي طفل در معرض خطرباشد محكمه مي تواند به تقاضاي اقرباي طفل يا به تقاضاي قيم او يا به تقاضاي رئيس حوزه قضايي هر تصميمي را كه براي حضانت طفل مقتضي بداند ، اتخاذ كند
ماده ۱۱۷۹ ابوین حق تنبیه طفل خود را دارند ولی به استناد این حق نمی‌توانند طفل خود را خارج از حدود تأدیب، تنبیه نمایند
ماده ۱۲۳۳ زن نمی‌تواند بدون رضایت شوهر خود، سمت قیمومت را قبول کند
ماده ۱۲۴۱ قیم نمی‌تواند اموال غیرمنقول مولی‌علیه را بفروشد و یا رهن گذارد یا معامله‌ای کند که در نتیجه‌ی آن، خود، مدیون مولی‌علیه شود مگر با لحاظ غبطه‌ی مولی‌علیه و تصویب مدعی‌العموم. درصورت اخیر شرط حتمی تصویب مدعی‌العموم ملائت قیم می‌باشد و نیز نمی‌تواند برای مولی‌علیه بدون ضرورت و احتیاج قرض کند مگر با تصویب مدعی‌العموم
ماده ۱۲۴۲ قیم نمی‌تواند دعوی مربوط به مولی‌علیه را به صلح خاتمه دهد مگر با تصویب مدعی‌العموم
ماده ۱۲۴۳ در صورت وجود موجبات موجه، دادستان می‌تواند از دادگاه مدنی خاص تقاضا کند که از قیم تضمیناتی راجع به اداره‌ی اموال مولی‌علیه بخواهد. تعیین نوع تضمین به نظر دادگاه است. هر گاه قیم برای تعیین نوع تضمین حاضر نشد، از قیمومت عزل می‌شود
ماده ۱۲۴۴ قیم باید لااقل سالی یک مرتبه حساب تصدی خود را به مدعی‌العموم یا نماینده‌ی او بدهد و هر گاه در ظرف یک ماه از تاریخ مطالبه‌ی مدعی‌العموم حساب ندهد به تقاضای مدعی‌العموم معزول می‌شود

هزینه ایران و برد ترکیه

در حمله کماندوهای اسرائیلی به ناوگان امدادرسانان بین المللی، ترکیه بیشترین قربانی را داد. شهروندان ترکیه برای نخستین بار پس از چند دهه، هدف گلوله نیروهای خارجی قرار گرفتند. اما در بسیاری از معرکه های تاریخ این قربانی بوده که پیروز میدان شده، حمله به کشتی مرمره آبی هم اگر پیروزی داشته باشد، ترکیه است
روزنامه النهار لبنان تیتر زده است: ناوگان آزادی، اسرائیل را در خون ترک ها غرق کرد
در تظاهرات بزرگ بعد از ظهر سه شنبه اول ژوئن در بیروت، در یک دست تظاهرکنندگان پرچم لبنان، فلسطین، حزب الله، جنبش امل یا دیگر گروه های سیاسی لبنان بود و در دست دیگر، پرچم ترکیه . در کنار پوسترهای یاسر عرفات و جمال عبدالناصر، تصویر رجب طیب اردوغان خودنمایی می کرد، پیراهن های تیم ملی فوتبال ترکیه بر تن جوان ها بود و فضا آکنده از شعار ترکیه، ترکیه. از یک روز پیش از تظاهرات و پس از آن، کاروان های موتورسوار هواداران حزب الله و جنبش امل با پرچم ترکیه در خیابان های شهر حرکت می کردند. اما از پرچم ایران، پر سر و صداترین حامی فلسطینیان، خبری نبود

از پارس برآمدم

The World Conference against Racism in Geneva, the Food and Agriculture Organization (FAO) Summit in Rome, five yearly UN general assemblies in New York, and now, Mahmoud Ahmadinejad is preparing for his eighth trip to participate in yet another UN conference—this time the Review Conference of the Parties to the Treaty on the Non-Proliferation of Nuclear Weapons (NPT). Former Iranian president’s aggregate trips to the UN (and its various meetings) are probably significantly less than Ahmadinejad’s.

In diplomatic conventions, the presence of the head of state at a conference signifies its importance for that country. Nevertheless, the Iranian president’s participation in a conference held at the level of foreign ministers -or lower- is unlike anything we’ve seen before. It may also imply that Mr. Ahmadinejad does not believe his foreign minister fully capable of leading the Iranian delegation.
It often seems that our president cannot resist the lure of the spotlight, whether it is inside the country or on the international scene. International reaction to President Ahmadinejad’s latest foray—one of general surprise—especially from UN Secretary General Ban Ki-moon, is surely proof enough. (And it doesn’t make it any better knowing that Ahmadinejad’s record is not much of a cause of pride for Iranians.)

In his first appearance at the UN General Assembly in 2005, Iran’s nuclear proposal was overshadowed by the president’s now notorious story of an “Aura of Light”—which Ahmadinejad claimed had surrounded him during his speech. His masterpiece of diplomacy though, was attending the UN Geneva conference against racism (Durban II) and giving a virulent anti-Israel speech which could not have made the Jewish state any happier at the time, diverting attention away, as it did, from Israel’s atrocious attacks on the people of Gaza (which had raised the ire of the international community only a few months earlier). Gaza, it seemed, was forgotten almost before his speech ended and as attendees walked out in protest.

Interestingly, many of the meetings involving President Ahmadinejad, especially his most recent address to the UN General Assembly in 2009, have seen more than half of the delegations present simply walk out. And at the FAO conference in Rome, Ahmadinejad and Zimbabwean President Robert Mugabe were the only attendees not invited to the UN dinner.

It is not yet clear what Mr. Ahmadinejad’s motive is for attending the Review Conference of the Parties to the Treaty on the Non-Proliferation of Nuclear Weapons (NPT). Does he have any plans to convince the international community of the peaceful nature of Iran’s nuclear program? Secretary General Ban Ki-Moon was quoted as saying that if “he brings some good constructive proposal in resolving Iranian nuclear issues, that will be helpful”. We would also hope that Mr. Ahmadinejad puts forth a plan that defends our inalienable rights and respects our dignity, although Iran’s international profile is an altogether different issue.

There is now the worry that despite the Iranian president’s presence, the NPT conference may still turn into a platform for criticizing Iran’s nuclear program. President Obama must have had such plans in mind when he hosted world leaders in April at the Nuclear Security Summit—what was certainly a prelude to the UN conference. If that is the case, Ahmadinejad will have attended yet another futile but controversial conference which only undermines our national interests.
